REPORT: Criminal defendants released by judges are reoffending; AG calls out judges


The following is a report issued by Attorney General Douglas Moylan:

This election was about stopping the recurring cycle of “Catch Release & Re-offend.” (“CR&R”)

Since 1/2/23 the AG’s Office has tracked defendants released by our Magistrate Judges. The breakdowns are attached, and show:

  • Hon. Benjamin Sison: 9 persons released violated by Prob.
  • Hon. Jonathan Quan: 1 person released violated by Prob.

Of the 11 persons who violated MJ Sison’s release orders, 2 of them allegedly committed another crime (harassment & burglary), arguably creating more crime victims. The Court’s probation officers file violations of defendants, and more may be forthcoming for past 2 mos. of releases. See www.oagguam.org for the CR&R magistrate docs. detailing attached report.

Defendants are presumed innocent. GPD officers arrest based on probable cause. The AG’s Office fights to keep defendants locked up or a “realistic bail” imposed. Without tough release conditions, defendants create more crime victims in our Villages. We oppose release on “performance bonds” since they require no money, don’t get paid, and cost too much atty. time to pursue. In order to stop the CR&R cycle we will continue to ask our Judges to incarcerate defendants or set bail that will actually protect this community, and ensure their compliance with release orders. A pro-incarceration policy protects us & works.

    How many people have been released? That is a low rate of violations if the number is 50 or more. Stop using the media to try to control the judiciary. Its unethical and pandering. Why don’t you instead commend all those who have been working to support their family upon their release?

      Hafa Adai. This is public information which the law abiding crime victims have a right to know. As a taxpayer funded Public Defender and a position under the Judiciary you should refrain from your defamatory and derogatory characterizations against persons attempting to keep this community safe.

    • Hattori, why would the AG waste his precious time commending those doing good? It’s you that’s brown nosing the judiciary.

  • I agree with the new AG with reference to disclosing issues to the public especially when it comes to the judicial system in Guam. We all need to keep in mind a safer Guam is a safer community. People should be held accountable for their actions.
