40-minute jury verdict may send thief to prison for six years


The Office of the Attorney General of Guam again successfully prosecuted a criminal defendant at trial in the court of Judge Alberto Tolentino. On July 3, 2023, a jury returned guilty verdicts against Timothy Kenit Suta for felony Theft by Receiving, and Criminal Trespass as a misdemeanor.

“[W]e will seek the maximum sentence from Judge Tolentino of six years,” the OAG news release on the matter states.

“Thieves and burglars are criminals who deserve to be punished to the fullest extent of the law,” the release goes on to state. “Deterrence begins by forcing the guilty to face justice in front of our people.”

Mr. Suta’s face may very well find its way onto a billboard. The OAG, in a campaign to shame criminals and to help would-be felons from offending, has begun printing and erecting giant signs at intersections. The first sign that has been stood up includes the face and name of a convicted murderer depicted behind bars.

Mr. Suta was arrested and charged in October 2021 of both charges for which the jury has convicted him. He was indicted then for a July 27, 2021 early morning theft of multiple electronics, and even a school bag, from a Mongmong home while a family was sleeping. There were four children in the home. Two of them heard noises coming from the living room; they assumed their mother was in the living room.

According to the OAG news release, Mr. Suta “has a criminal history.” Attorney General Douglas Moylan has been prioritizing the prosecution of violent and drug crimes allegedly committed by repeat offenders. He vehemently opposes the release of criminal defendants pending trial, unless judges require cash bail as a condition of release, among other conditions.

“Luckily this time no threats of violence or violence occurred against this family,” the OAG news release states.
