Judges continue releasing defendants who go on to commit new crimes

Superior Court of Guam judges continue to release criminal defendants from jail, who go on (allegedly) to commit more crimes. According to the Office of the Attorney General’s November monthly report of defendants who reoffend while on court-ordered release conditions, most of the alleged new crimes are drug related.

One of the defendants was released from jail following a misdemeanor family violence charge, then allegedly committed felony family violence against the same victim, according to the report.

“Something is clearly broken that needs to be fixed,” Douglas Moylan, the attorney general, said in a news release. “Release conditions must be stricter, or defendants not released at all to protect us from becoming crime victims.”

In total in November, 89 people allowed pretrial and post-trial release from jail and prison allegedly violated the conditions of their release, with 18 of them charged with a new crime.

“In the past 30 days 18 more crimes, or about three times the number of crimes charged in October occurred from those criminal defendants released from another criminal case,” Mr. Moylan pointed out.
