Police allege a 17-year-old boy admitted to sexually assaulting two girls, ages six and seven.
“[T]he defendant told officers that before Thanksgiving this year … [he] told [the two girls] to take off the clothes and that he touched both of them on their butt and vaginas until he ejaculated,” the prosecutor wrote in her affidavit of probable cause to charge the boy with eight counts of second degree criminal sexual conduct as first degree felonies.
He was charged as an adult and faces life in prison if convicted at trial.
The seven-year-old girl told police the sexual encounters happened five times to both of them. The affidavit does not specify who called police, but does state the victims’ aunt spoke to police about what the girls told her the same day police were called.
According to the affidavit, the boy also admitted to pressing his penis “on both of their butts until he ejaculated.” The incidences happened between November 1 and December 15, 2023, according to the report. He told the victims not to tell anyone what was going on, according to the report.
The affidavit does not state whether the boy’s parents or guardians consented to the police questioning, or when his rights were read to him. These details often are included in the affidavits of probable cause presented to the magistrate judge prior to charging.
The attorney general has opposed the boy’s release from custody, consistent with his policy since returning to office to fight for the denial of jail release of every defendant charged with a violent crime.
